Transport refers to the act of carrying a weapon or ammunition across the border, or having it transported, with the aim that the weapon remains there. The owner of the weapon changes, thus the scope of the relevant laws is different.
Scenarios:
Individual Case Transport:
A dealer or a private individual sells a weapon abroad, also to a dealer or a private individual. For this, permission must be applied for at the responsible weapons authority. A prerequisite for this is the prior consent of the member state to which the weapon or ammunition is to be transported. Additionally, safe transport must be ensured.
There is no obligation for the dealer to notify the Federal Administrative Office (BVA) - this is initiated by the weapons authority. However, if the weapon is to be transported to a third country (not EU or Schengen state), it is necessary to contact the Federal Office for Economic Affairs and Export Control (BAFA).
Documents: The required permit must be carried during transport. Customs documents are not included in this; customs clearance must be carried out separately.
General Permit:
This permit, valid only within the EU, is required for weapons dealers who trade across borders with other weapons dealers commercially. The permit must be applied for at the responsible weapons authority and is valid for up to three years. There may be restrictions on the permit for certain firearms, ammunition, or specific countries.
In this case, the German weapons dealer must submit a written notification to the Federal Administrative Office before each transport to a dealer from another EU member state.
Notification to the Federal Office for Economic Affairs and Export Control is not required, as this would only be necessary for transport to a third country. However, the General Permit will not be issued for this purpose.
Documents: Instead of the original permit, a declaration referring to the permit can be carried.
