Transfer means to transport a weapon or ammunition across the border, or to have it transported, with the aim that the weapon remains there. Thus, the owner of the weapon changes. the scope of the relevant laws is different.
Scenarios:
Single case transfer:
A dealer or a private person sells a weapon abroad, also to a dealer or a private person. For this, permission must be applied for from the relevant weapons law authority. The prerequisite for this is the prior consent of the member state to which the weapon or ammunition is to be transferred. In addition, safe transport must be guaranteed.
There is no obligation to notify the Federal Office of Administration (BVA) by the dealer - this is arranged by the weapons authority. However, if the weapon is to be shipped to a third country (non-EU or Schengen country), it is necessary to contact the Federal Office of Economics and Export Control (BAFA) .
Papers: The required permit must be carried with the shipment. Customs papers are not included here, customs clearance must be carried out separately.
General permit:
This permit, valid only within the EU, is required for arms dealers who trade commercially with other arms dealers transnationally. The permit must be applied for at the responsible weapons authority and is valid for up to three years. There may be restrictions on the permit to certain firearms, ammunition or certain countries.
In this case, the German arms dealer must submit a written notification to the Federal Office of Administration before each transfer to a dealer from another EU member state.
There is no need to notify the Federal Office of Economics and Export Control, as this would only be required in the case of transfers to a third country. However, the General Permit is not issued for this purpose.
Documents: Instead of the original permit, a declaration referring to the permit can be carried.
